FULL TERMS & CONDITIONS OF SERVICE

Including Operational Rules, Rider Responsibilities, Waiver of Liability, and Assumption of Risk

This document contains the complete Terms and Conditions governing the use of bicycles provided by BevMae Enterprises LLC (“Operator”), doing business as Trail Town Bikes. By using the bike share program, Rider acknowledges and agrees to these terms in full.

1. Purpose of Agreement

This document is a binding agreement between Rider (the individual using the Bike) and Operator (BevMae Enterprises LLC). By using the Bike, Rider waives and releases certain rights and claims, and accepts specific risks and responsibilities.

2. General Use of Bike

- Rider must be at least 15 years old; minors under 18 require parental consent.
- Rider must be competent, physically fit, and able to operate a bicycle safely.
- The Bike and all equipment remain the property of Operator and may not be modified.
- Rider agrees to ride only during designated hours (generally sunrise to sunset).
- Bikes must be returned within the permitted time and to designated stations.
- Rider must obey all traffic and bicycle laws.
- Helmets are provided, but Operator makes no warranty as to their safety; Rider assumes all risk.
- Rider must inspect the Bike before each use (tires, brakes, steering, chain, etc.).
- Rider may not operate the Bike while impaired by alcohol or drugs.
- No riding in dangerous weather conditions.
- No racing, stunt riding, off-road use, or other prohibited activity.
- No passengers; no towing or pulling objects.
- Basket use limited to 20 lbs (or less depending on Rider’s ability).
- Rider must not transport the Bike by vehicle or remove it outside the designated area.

3. Rider Responsibilities

- Rider must return Bike in same condition received, ordinary wear and tear excepted.
- Rider is liable for lost, stolen, or damaged Bikes up to the full replacement cost.
- Rider must keep Bike locked and secured when unattended.
- Rider is liable for all fines, fees, or violations incurred during use.
- Rider must report accidents or incidents in writing to Operator within 7 days.
- Rider must report stolen or lost Bikes immediately to Operator and Police.
- Rider authorizes Operator to charge penalties or replacement fees as needed.

4. No Insurance Provided

Rider acknowledges and understands that Operator does not provide any insurance to cover property damage, personal injury, injury to others, damages, expenses, penalties, losses, or costs of any kind. Rider is solely responsible for all such expenses, including medical costs.

5. Waiver & Release of Liability

Rider hereby releases and discharges Operator, its employees, officers, directors, agents, sponsors, insurers, affiliates, and manufacturers/donors of Bikes from any and all claims, liability, causes of action, or damages, including those arising from negligence, related to the use or operation of the Bike or participation in the program. This release applies to Rider and Rider’s heirs, executors, and assigns.

6. Assumption of Risk

Rider acknowledges that bicycling is a hazardous activity involving risks of injury, disability, and death. These risks include but are not limited to: collisions, falls, equipment failure, road hazards, weather conditions, and negligence of Rider, Operator, or others. Rider freely assumes all such risks.

7. Indemnification

Rider agrees to indemnify, defend, and hold harmless Operator and related parties against any and all claims, losses, liabilities, damages, attorney’s fees, and costs brought by third parties arising from Rider’s use of the Bike.

8. No Warranty

Operator provides Bikes and equipment 'AS IS' without warranties, express or implied, including merchantability or fitness for a particular purpose.

9. Governing Law & Jurisdiction

This Agreement is governed by Pennsylvania law. Any disputes must be filed exclusively in the courts of Luzerne County, Pennsylvania.

10. Severability

If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

11. Entire Agreement

This document represents the entire agreement between Rider and Operator. Operator may revise these Terms at any time by posting updates on the program website. Continued use of the Bike constitutes acceptance of any revisions.
